Charges Dropped in Bizzare NYC Case

April 24th, 2008 · No Comments

Charges have been dropped against two men that were accused of wheeling their dead roommate throughout Manhattan in an attempt to cash his social security check.

The two roommates named in the case, O’Hare and Daloia, faced charges of criminal possession of a forged instrument in connection with the intial charge. A Manhattan judge dismissed the charges recently, arguing that it could not be proven beyond a reasonable doubt that the man was dead when the roommates left their home with him. A medical examiner confirmed the judge’s thoughts, stating that the man had died of natural causes and he would be unable to determine the time of death.

The two roommates say that their roommate was alive when they left home and that they had been given permission by the roommate to cash the social security check in order to pay for shared monthly expenses.

April 10th, 2008 · No Comments

The criminal defense lawyer representing the teen who is facing criminal charges for the murder of a Duke University graduate student is working diligently to control the information supplied by the police investigation. The release of too many details presents a viable threat to her client’s right to a fair trial. Lovette’s attorney notes that the overwhelming publicity of the trial may have the “unavoidable effect of denying this defendant of his constitutional rights.”

Lovette, the teen on trial, has been charged with first-degree murder. He is also accused of killing another student who was found on the UNC-Chapell Hill campus. Lovette’s attorney is seeking the protective order after a lead investigator leaked information about the case in the presence of a reporter. The information from Lovette’s criminal record that had been divulged was information that amassed before Lovette’s 16th birthday. This information is usually kept public.
