Lack of Criminal Responsibility Defense

A woman plans to use a lack of criminal responsibility defense as she faces trial for the murder of her infant daughter. Gennifer Glum, 26, was charged in December for the asphyxiation death of her young daugther and pleaded not guilty to the class AA felony in February. As the trial continues, Glum requested that her lawyer file a notice that she would use the defense of lack of criminal responsibility since she claims she lacked the state of mind needed to commit the crime.

Mental health professionals have examined the woman and their evidence will be used to support the defense. In a previous hearing, Glum was found to be an “incapacitated person” by the judge and her parents were appointed to act as her guardians. With the mental capacity of a 12 year old, Glum’s parents do not believe their daughter should be charged with consideration of her mental state.

The baby girl was born on December 6th around 4pm, but by 4:30pm Glum’s father had called 911 to report that the baby was unresponsive. The baby was pronounced dead at the hospital later in the day. If convicted, Glum faces a maximum penalty of life in prision without parole.
